Implementing the New Constitutional Treaty: A Provisional Introduction

Abstract:

    The paper argues that there are a number of problems about the proposed constitutional treaty emerging from the Convention. It sets these in context by asking why the enterprise was started, what the Praesidium's strategy has been and what criticisms have been made of the process. Next it looks at the practical problems involved in fleshing out the existing outlines, including adding the Charter of Fundamental Freedoms and Rights. It argues that there is still a lot of difficult work to be done and examines some possible scenarios for implementing the treaty. The conclusion is that the packaging of the treaty is more problematic than is often realised.
